1. What information do we collect?

We collect personal information that you voluntarily provide to us when you register on the Services, express an interest in obtaining information about us or our products and Services, participate in activities on the Services, or otherwise contact us. The personal information we collect may include: names, phone numbers, email addresses, and SMS message content and metadata.

We do not process sensitive information.

Some information — such as your IP address and/or browser and device characteristics — is collected automatically when you visit our Services. This includes log and usage data, device data, and location data, and is primarily needed to maintain the security and operation of our Services and for internal analytics.

2. How do we process your information?

We process your personal information to facilitate account creation and authentication, to deliver and facilitate our Services, to respond to inquiries and offer support, to request feedback, to send administrative and (where permitted) marketing communications, to identify usage trends, and to protect our Services. We only process your personal information when we have a valid legal reason to do so.

3. What legal bases do we rely on?

We only process your personal information when we believe it is necessary and we have a valid legal reason to do so under applicable law — for example, with your consent, to comply with laws, to provide you with services, to protect your rights, or to fulfill our legitimate business interests. Where required (such as in the EEA, UK, and Canada), we rely on consent, legitimate interests, legal obligations, and vital interests as our legal bases.

4. When and with whom do we share your information?

We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company. We may also disclose personal information to service providers pursuant to a written contract.

We may use cookies and similar tracking technologies to gather information when you interact with our Services, including for security, basic site functions, analytics, and advertising. 6. Do we offer AI-based products?

We offer products, features, or tools powered by artificial intelligence, machine learning, or similar technologies (“AI Products”), provided through third-party AI service providers including OpenAI. Your input, output, and personal information may be shared with and processed by these providers to enable your use of our AI Products. All personal information processed using our AI Products is handled in line with this Privacy Notice and our agreements with those providers.

7. How do we handle your social logins?

If you choose to register or log in to our Services using a social media account, we may receive certain profile information about you from your social media provider. We use the information we receive only for the purposes described in this Privacy Notice.

8. How long do we keep your information?

We keep your personal information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless a longer retention period is required or permitted by law. When we have no ongoing legitimate business need to process your personal information, we will delete or anonymize it, or securely store and isolate it where deletion is not immediately possible.

9. How do we keep your information safe?

We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, no electronic transmission or storage technology can be guaranteed to be 100% secure.

10. Do we collect information from minors?

We do not knowingly collect data from or market to children under 18 years of age. If we learn that personal information from users under 18 has been collected, we will deactivate the account and take reasonable measures to promptly delete such data. 11. What are your privacy rights?

Depending on your location, you may have rights that allow you greater access to and control over your personal information, including the right to access, correct, delete, and obtain a copy of your personal information, and to withdraw consent. To exercise these rights, contact us using the details below. If you are relying on consent, you may withdraw it at any time; this will not affect the lawfulness of processing before its withdrawal.

12. Controls for do-not-track features

Because there is currently no uniform technology standard for recognizing and implementing Do-Not-Track (DNT) signals, we do not currently respond to DNT browser signals. If a standard is adopted in the future, we will inform you in a revised version of this Privacy Notice.

13. Do United States residents have specific privacy rights?

If you are a resident of certain US states, you may have the right to request access to and details about the personal information we maintain, correct inaccuracies, obtain a copy of, or delete your personal information, and to withdraw consent. We have not sold or shared personal information to third parties for a business or commercial purpose, and we will not sell or share personal information belonging to website visitors, users, and other consumers in the future. 14. Use of Google APIs

We do not use data obtained from Google Workspace APIs to develop, improve, or train generalized AI or ML models. Our use of these APIs is limited to the specific features and functionalities required to operate our Services, in accordance with Google’s API Services User Data Policy, including its Limited Use requirements.

15. SMS/MMS communications

When you interact with us by SMS or MMS, we collect limited information needed to deliver the service, we keep records of your consent and opt-out, and we do not share your phone number with third parties for marketing.

SMS data we collect. When you interact with us via SMS or MMS, we collect your phone number, message content, timestamps, and carrier information for the purpose of delivering AI agent responses and transactional notifications.

SMS consent records. We maintain records of your SMS opt-in consent, including the date, time, and method of consent (web form, verbal, or text keyword), as required by applicable wireless-carrier and regulatory rules, including the CTIA Messaging Principles and Best Practices and the Telephone Consumer Protection Act (TCPA).

SMS data retention. SMS message logs are retained for 18 months for quality assurance, dispute resolution, and compliance purposes, and then automatically deleted.

SMS opt-out rights. You may revoke SMS consent at any time by texting STOP to any of our numbers. Your opt-out preference is processed immediately. You may also text HELP for assistance or email support@ksgai.com.

No SMS data sharing for marketing. Phone numbers collected for SMS are used solely for delivering the requested service communications and are not shared with third parties for marketing purposes.

SMS service provider. KSG uses Twilio, Inc. as our SMS/MMS service provider to deliver messages that our AI agents send on behalf of our business clients. Twilio processes phone numbers, message content, and delivery metadata as our processor under contract. Twilio’s privacy notice is available at https://www.twilio.com/legal/privacy.

16. Scope of data sharing in this notice

Any references in this Privacy Notice to sharing personal information with third parties, affiliates, business partners, or service providers apply only to data collected through our marketing website at ksgai.com — for example, cookies, IP address, page-view analytics, and information you submit through our contact and opt-in forms.

These references do not apply to customer conversational data, opt-in phone numbers, message content, or any end-user information that flows through our AI agent platform. We do not sell, share for marketing purposes, mine, or otherwise disclose such platform data. We process it only to deliver the service our business customer has hired us to provide. The business customer is the controller and owner of that data; KSG is the processor.

Phone numbers collected through SMS opt-in remain inside the customer account that received the opt-in. They are never shared with any other customer, third party, or affiliate.

We may update this Privacy Notice from time to time. The updated version will be indicated by an updated date at the top of this Privacy Notice. We encourage you to review it frequently to be informed of how we are protecting your information.
